No retrospective would be complete without remembering the contributions of leading figures who have helped shape the industry. In this issue recognizing todays top contractors (see page 27), it is fitting to salute some of the pioneers from CONCRETE CONSTRUCTIONS early days. It was Corbettas dedication to the development of a strong concrete industry, however, that earned him the moniker Mr. Concrete. He was instrumental in founding several organizations, starting in 1950 with the Concrete Industry Board of New York City, which brought together concrete contractors, producers, architects, engineers, testing labs, cement manufacturers, and reinforcing steel producers.
The Concrete Centres activities and achievements have made significant progress during 2006. The UK has one of the lowest per capita consumptions of cement and concrete in the world. The Concrete Centre has been set up to address this by ensuring that the key decision makers and influencers in the construction industry are made fully aware of the wide range of benefits and attributes that concrete has. The most critical project stages that assist in the formulation of a decision as to whether or not to go with concrete are the feasibility study and detailed design. It is at these stages that the frame material is determined. Therefore, it is essential that the decision makers involved are able to make a fully informed choice in terms of structural design, construction methods, fire performance, environmental and acoustic performance and thermal efficiency. We in the concrete industry need to ensure that best practice information on the most efficient forms of concrete construction is available to design teams. The resources and advice provided by The Concrete Centre prove invaluable at this critical stage of the design process.

Last month I wrote about the Lawyers-Helping-Lawyers Committee as a resource for an impaired lawyer. I wrote about courage and compassion to oneself and to fellow attorneys to admit impairment and to seek recovery. Today I want to discuss the equally troubling and less pollyannaish facts of life — many impaired lawyers refuse assistance. When you have mustered the courage to confront a fellow attorney about an impairment, you have done so assuredly because you have become convinced that your friends impairment is destroying his life. You already know that that person must get help — voluntarily or involuntarily. You know that to allow them to continue impaired leads only to death and destruction. Death in a physical sense for the impaired lawyer through alcoholism, drug abuse or suicidal despair. Death for innocent people who die, for example, in auto accidents when your impaired friend gets behind the wheel. Destruction for the impaired lawyers family and loved ones who cannot continue living sane and dignified lives with the impaired person. Destruction for the impaired lawyers clients who do not receive the competent, diligent representation they deserve. As a matter of morality, you should act to save your friend and (indirectly) those around him — family, innocent people, clients. As a matter of self-protection, you must act because failure to act can lead to professional discipline. The Bar is a self-regulating profession. If you have knowledge of a lawyer or a judge impaired in their fitness for professional duties, Rules of Professional Conduct (RPC) Rule 8.3 mandates that you “shall inform the appropriate professional authority.” Failure to report when appropriate is itself a disciplinary violation. If you are a partner or a supervising lawyer, you are accountable under RPC Rule 5.1 for anothers ethical violations if you have failed to adopt the reasonable measures in your firm that assure compliance with ethical conduct. In addition, Rule 5.1 also imposes personal ethical responsibility upon you if you know of an impairment and fail to take reasonable remedial actions that can avoid or mitigate the consequences of anothers (the impaired lawyer) professional misconduct. As these violations of Rule 5.1 are your personal ethical obligations, you may also have malpractice liability for your failure to act to prevent harm, even though you have tried to insulate yourself by becoming a limited liability company or a limited liability partnership. Who is the appropriate professional authority to whom you must report an impaired lawyer? As I have already intimated, if the impaired lawyer is willing voluntarily to seek recovery and has not committed an ethics violation, the appropriate professional authority is the Lawyers- Helping-Lawyers Committee. You may refer the impaired lawyer willing to seek recovery to the L-H-L for the committees guidance, counseling and monitoring. As to the recalcitrant impaired lawyer, the appropriate professional authority is the general counsel of the Bar Association. The general counsel may invoke Rule 10 (suspension for personal incapacity to practice law) of the Rules Governing Disciplinary Proceedings (RGDP). Under Rule 10, the general counsel may initiate a proceeding to suspend the incapacitated lawyers license. If suspended, the Supreme Court will not return the lawyers license until the lawyer can prove, through reinstatement proceedings, that he once again has the personal capacity to practice law. Rule 10 means to protect clients and the public from an impaired lawyer. Rule 10 is not geared toward disciplining (punishing) a lawyer for an ethics violation. Consequently, Rule 10 is a confidential proceeding on a separate, non-public docket under the direct supervision of the chief justice. By contrast, if the impaired lawyer has already caused a harm to a client that violates the Rules of Professional Conduct, the appropriate professional authority is again the general counsel of the Oklahoma Bar Association. But now the general counsel invokes the usual disciplinary procedures in RGDP Rule 6. These disciplinary procedures are open to the public once the court clerk of the Supreme Court files the formal complaint and the respondent lawyers answer. When the general counsel becomes involved through either Rule 10 or Rule 6 in proceedings relating to an impaired attorney, the general counsel also invokes RGDP Rule 12 (winding up business of lawyer who is deceased, incapacitated or missing not pending disciplinary proceedings). Rule 12 is a relatively new rule, adopted in December 1996. Rule 12 authorizes the general counsel to exercise oversight appropriate to the circumstances to protect the impaired lawyers clients. Lawyers need courage and compassion about impairment for themselves and for fellow lawyers. Lawyers also need awareness of their ethical obligations to report impaired lawyers to the appropriate professional authority. RARE birds of prey are being watched around the clock to protect them from poachers. More than 30 volunteers, CCTV cameras and night vision gadgets are being used to protect a pair of hen harriers nesting on Forestry Commission land in Northumberland, from being shot or having their nest and eggs destroyed. Hen harriers are one of Englands rarest birds, with only 15 successful nests recorded by the RSPB in 2007.

HUTCHESONS Hall, with its hand-laid mosaics, encaustic tiles and Minton fireplaces, is the ideal location for a National Trust exhibition on Glasgows glorious tiles. As an architectural feature, they adorn civic buildings, churches and institutions, grand houses, shops, pubs and tenements. The “wally close” is surely one of the citys finest inventions. Tiles came from England, brought up via the expanding railway network. Some builders would buy in a job lot, explaining some spectacular tiles in quite unassuming locations. Photographer Ron Hills record of close and shop tiles, taken before door entry systems and redevelopment destroyed many tenements, takes us all over Glasgow and Paisley, down the way to Largs, Kilmacolm and the Clyde coast. A close tile from Glasgows west end has a twin in Greenock. Hill has captured J Duncan of Glasgows beautiful panels with scenes from the Firth of Clyde, featuring the Cloch lighthouse, the Cowal hills, yachts and paddle-steamers. His interior shots include not only the tiles. The theme is continued in the painted glass door panels, on landing windows, the bannisters and railings. Another National Trust property, the Tenement House, features tiled fireplaces, hearths, washstands and umbrella stands. They are not all original to the house but, as in any home, when things got broken they were replaced with what was available. Holmwood House, designed by Alexander “Greek” Thomson, houses a wonderful display of colourful encaustic tiles by Minton and Maw. Even the larder walls are lined in attractive blue and white tiles, possibly a Minton design. A lucky find came last October. A small toilet at the back of Hutchesons Hall was demolished, uncovering an impressive mock mosaic floor. Research revealed it had been upgraded when the City Chambers was being built, around 1888, and the Lord Provost used Hutchesons Hall for all civic functions. Many of the exhibits are on loan from Glasgow museums or from private collections which contain tiles salvaged from closes, shops and showrooms during the last two decades. They come from fireplaces, washstands, floors and wally closes. Some are encaustic tiles, others tube-lined, transfer-printed, hand-painted and relief-pressed. Designs and styles go to art deco and beyond, each a work of art in its own right. Identification has not always been possible. Many of the potteries had no mark or, if they did, these markings have long since disappeared. A few of the artists employed by the bigger potteries are instantly recognisable - both William Wise and Moyr Smith worked for Minton - but the vast majority remain anonymous. Their work, however, lives on. On The Tiles is at Hutchesons Hall, Ingram Street, Glasgow from April 24 until May 23. It is supported by Murray Johnstone. But the company first wanted to partner with specialty dealers before introducing the glass tiles in venues like The Great Indoors and Home Depots Expo Design Centers. He said, however, that both store concepts are ideal channels for Euro-Tiles glass tiles. “Its not painted on, like the color on most glass tiles, so it will never come off,” he explained. Euro-Tiles products are currently being manufactured in Austria, but the company is building a plant in Fort Myers that should be operational next year. Euro-Tiles patented manufacturing process involves melting metal pigments into the back of the tile, and then baking the tile for nine hours. The result is what Tschernitz calls “a homogeneous tile,” with color that wont scratch or fade.

Exercise and Cancers: Research Opportunities for Health-Related Fitness ScientistsRepresentatives from the American Cancer Society (ACS), the National Cancer Institute (NCI), and the Centers for Disease Control (CDC) will challenge AAHPERD members to contribute to cancer prevention and control, describing the most promising research opportunities and resources to support investigation of the relationships between cancers and exercise. The presentation will be based on a synoptic article being developed by the ACS and the Office for Health Promotion of Northern Illinois University. Ruth Corcoran of ACS will describe a proposed collaborative research agenda, suggesting that two sets of consensually developed guidelines are needed to promote such research: one set to facilitate dissemination of what experts already know to the public and providers (including exercise specialists); and a second set to facilitate further collaborative research. Speakers from CDC and NCI will outline what is known about these topics, and how exercise scientists can contribute to further development (see accompanying abstracts). Presenters will recommend a process to develop research priorities, involving cancer experts, public health scientists, and relevant interest groups in AAHPERD. Photography might just be the best way to capture New York Citys snappy charms. Certainly from the late 1930s to the early 1960s, photographers such as Diane Arbus, Weegee and Richard Avedon made their reputations by getting out and about on the citys busy streets, immortalising whatever they saw. Christened the New York School, these snappers always worked in a democratic vein, interested in everyone, no matter if it was a couple kissing in a cinema or two children pulling faces on a sidewalk. This academic satire is about two professors and their families. Howard Belsey is a white secular liberal, a specialist in Rembrandt, who is engaged in ideological warfare with a visiting professor, Monty Kippes, a conservative Christian scholar from Trinidad. Each character in the story is undermined by his or her self-deceptions. Howards attachment to theoretical knowledge seems to preclude understanding or controlling his adulterous behavior. Smith brilliantly draws these and other characters and gently but wittily pierces their illusions and pretensions. Howards African-American wife, Kiki, is one of the few characters to offer emotional or moral ballast, along with her son Jerome, who rejects his parents secularism for a newfound Christianity.

Not a beautiful thing, that. The government. Not beautiful, though a man would not use that word. One time my Uncle Ross from California called my moms Sunday dinner centerpiece lovely, and my father left the room, clearly troubled by the word lovely, coupled probably with the very idea of California and the fact that my Uncle Ross liked to tap-dance. The light from the venetian blinds, the autumn, silver Kansas light laving the table that Sunday, is what I recall now because it was beautiful, though I of course would not have said so then, beautiful, as so many moments forgotten but later remembered come back to us in slants and pools and uprisings of light, beautiful in itself, but more beautiful mingled with memory, the light leaning across my mothers carefully set table, across the empty chair beside my Uncle Ross, the light filtering down from the green plastic slats in the roof of the machine shop where I worked with my father so many afternoons, standing or crouched in pools of light and sweat with men who knew the true meaning of labor and money and other hard, true things and did not, did not ever, use the word beauty.Late November, shadows gather in the shops north end, and Im watching Bobby Sudduth do piecework on the Hobbs. Real Estate Brokers with the SRES designation help seniors make wise decisions about selling their home, buying rental property, managing the capital gains and estate tax implications of owning real estate, obtaining a reverse mortgage, moving to a senior community and other issues. The designation was introduced in 1997 and is nationally recognized.
Real estate practice is a broad and widely defined area of the law. In a pristine sense it deals with the esoteric subject of real property law and titles. In practice the subject matter handled by real property lawyers is much broader. Many of the areas of law within real estate practice are areas of specialty themselves. Real estate lawyers examine and evaluate real property titles, handle real estate sales, purchases and other transactions, foreclose mortgages, represent developers and contractors in drafting and negotiating development and construction agreements, handle real estate financing, structure and draft the governing documents for planned developments such as condominiums, serve as counsel to community and condominium associations, draft and negotiate leases, litigate title, boundary, and other land disputes, and advise clients respecting zoning and land: use matters. The examination of real estate titles requires knowledge of corporations and other forms of business organization, wills, trusts and estates, and a practitioner handling transactions must understand contractual, business, and tax subjects as well. The subjects that are tested on the certification exam attest to this diversity. They are title issues; real estate finance; environmental and land use; condominiums and homeowner associations; landlord tenant; closings; sellers, buyers, brokers, and title insurers; real property litigation; taxation of entities and other tax issues; and ethics. Some hold an impression that at least some aspects of the real estate practice are not challenging, that the practice is increasingly title company, form, and paralegal driven, and that when business is light any lawyer with a good paralegal can Ado real estate closings. This impression is not accurate. As with any area of practice, successfully representing clients in real estate matters requires knowledge, skill, and experience. The diversity in real estate practice may mean that no one lawyer can be an expert in each practice area encompassing the modern real property practice or that are tested by the certification program. That, however, is not a reason to not seek certification. The committee recognizes that few lawyers are likely to possess specific and detailed expertise in each of the many subjects that fall within the scope of real estate.
